Prices and product information.

We place great emphasis on ensuring the accuracy of all product details, descriptions, and prices at the time they are entered or updated. There may be instances where information is not fully up to date at the exact moment of purchase. Confirmation of a product's price is made upon acceptance of your order.

While we strive to uphold quoted prices, Berry's Farm Supplies reserves the right to modify product details, prices, and discontinue items as necessary without prior notice.

Product warranty.

When goods are returned under warranty, Berry's Farm Supplies will repair or replace them based on the manufacturer's conditions. The decision to repair or replace the item returned under warranty will be at the sole discretion of Berry's Farm Supplies. Warranty does not cover routine service work or repairs caused by misuse.

Delivery.

Unless explicitly agreed otherwise, Berry's Farm Supplies will deliver goods or services to the location specified in the order, or any other mutually agreed location. Delivery is complete upon arrival at the agreed location. Any quoted timeframe is an estimate only. We cannot be held responsible for repercussions arising from delays in delivery, or delays caused by circumstances beyond our control, or where the buyer fails to provide adequate delivery instructions.

Returned or cancelled goods.

Berry's Farm Supplies reserves the right to apply a 25% handling charge on any returned goods. To be eligible for return, goods must be in a saleable condition and remain unaltered. We retain the right to decline cancellation or return requests for specially ordered, specially made, large quantity, or custom-sized goods.

In the event of receiving damaged or faulty goods, customers are entitled to a full refund, including the basic delivery cost, provided they notify Berry's Farm Supplies of any damages or faults within 30 days of receiving the goods.

Payment terms.

All prices are to be paid in GBP sterling. For non-trade account holders, payment by credit or debit card is required at the time of placing the order. Customers with a trade account are expected to settle their payment within 30 days from the date of the invoice unless special settlement terms have been agreed upon beforehand.

In accordance with the provisions of the Late Payment of Commercial Debts (Interest) Act 1998, Berry's Farm Supplies reserves the right to charge interest on overdue accounts at a rate of 8% above the base rate of the Bank of England.

Liability.

Except in cases of death or personal injury caused by Berry's Farm Supplies' negligence, Berry's Farm Supplies will not be held liable for any breach of implied warranties, conditions, or other terms, or any duty imposed by the laws of England, or under the explicit terms of this agreement, for any direct or consequential loss or damage arising in connection with the performance of this agreement, unless expressly provided for herein.

Berry's Farm Supplies cannot be held responsible for any loss or damage resulting from the failure to promptly or completely deliver goods or services. Even if delays occur, the customer is still obligated to accept delivery and make full payment for the goods, provided delivery is attempted within 10 days of the agreed delivery date.

VAT.

All prices are exclusive of VAT, which will be applied at the prevailing rate on the date of sale.

Validity.

If any term in this contract is deemed invalid, the remaining terms will remain valid and enforceable without being affected by such invalidation.

Retention of title.

Title and ownership of goods remain with Berry's Farm Supplies until full payment, including any applicable taxes, has been received from the customer. Until payment, the customer agrees to keep goods separate and clearly identified as the property of Berry's Farm Supplies.

In the event of non-payment or default, Berry's Farm Supplies reserves the right to reclaim goods and enter the customer's premises to retrieve them. The customer grants Berry's Farm Supplies irrevocable authority to access the premises for this purpose. Until title transfers, the customer is not permitted to sell, transfer, or dispose of goods without explicit consent.

Collections.

If the customer has requested collection of goods, they are expected to collect from Berry's Farm Supplies premises within 7 days after receiving notification that goods are ready. Failure to collect within this timeframe may result in a daily storage charge, at our discretion.
